Welcome to Persona. These Terms of Use (the "Terms") form a legally binding agreement between you and Persona regarding your use of startpersona.com and any associated mobile web experience (collectively the "Service"). By creating an account, purchasing a subscription, or using the Service in any way, you confirm you have read, understood, and agree to be bound by these Terms and our Privacy Policy, Refund Policy, Subscription Policy, and Cookie Policy.

Plain-language summary. Persona is a science-backed personality-assessment tool built around peer-reviewed instruments (Big Five, attachment, inner-parts, Dark Triad, life satisfaction). It is not medical, mental-health, legal, or financial advice. Subscriptions renew automatically until you cancel. Read the full document below — it's short and written in plain English.

1. Eligibility

You must be at least 18 years old to use Persona. By using the Service, you represent and warrant that:

Persona is not intended for, marketed to, or designed for children. If you are a parent or legal guardian and believe a minor has created an account, contact privacy@startpersona.com and we will delete the account and all associated data promptly.

2. Your account

Creating an account

You may create an account by completing the Persona quiz and providing a valid email address. You are responsible for:

Account security

Notify us immediately at security@startpersona.com if you suspect unauthorised access. We will not be liable for losses caused by credentials being shared or stored insecurely on your end.

One account per person

We allow one active account per individual. Creating multiple accounts to circumvent trial limits, free-access grants, refund policies, or bans is a violation of these Terms and may result in all related accounts being suspended.

3. Subscriptions, trials & billing

Persona offers paid subscriptions billed through Stripe. Specific plan mechanics — trial lengths, upfront fees, renewal cadences, cancellation windows — are set out in our Subscription Policy, which is part of these Terms by reference.

To reduce fraud and chargeback losses we block prepaid cards and certain card-funding types at checkout. If your payment is declined for this reason you may retry with a standard credit or debit card.

4. Refunds & cancellations

See the Refund Policy for the complete rules. In short: trial fees are non-refundable once the trial has begun, but accidental renewals within 14 days of the charge are refunded on request. We review older claims in good faith.

6. Your content & license

What you own

Your quiz answers, mood entries, habit data, chat messages, profile data, and any content you input into the Service are yours. You retain all rights.

What you grant us

By submitting content, you grant Persona a limited, worldwide, royalty-free, non-exclusive license to store, process, and display that content solely to operate the Service on your behalf — for example, to score your quiz, generate your reading, drive your AI coach, and share what you've chosen to share with connections.

This license ends when you delete the content or close your account, except where retention is required by law (e.g. billing records for tax compliance).

Anonymous aggregation

We may use anonymised, aggregated, non-identifiable patterns from all users for product research, public reports, or academic collaboration. We will never publish data that can be tied back to you individually without explicit opt-in.

7. Intellectual property

All materials that constitute the Service — including the personality reports, archetype descriptions, famous-match analyses, the code, design, typography, illustrations, charts, text, trademarks, logos, and AI system prompts — are owned by Persona or its licensors and are protected by copyright, trademark, and trade-secret law.

Your subscription grants you a personal, limited, non-transferable, revocable license to access and display your individual reading and the Service's features for your own reflection, sharing with connections, or discussion with a professional. It does not grant you any rights to redistribute the Service, clone its architecture, or build a competing product from it.

8. Disclaimers & screening-tool nature

Persona is not a clinical product. Our assessments are based on validated research instruments, but they are screening tools, not diagnostic tools. Results may suggest patterns consistent with an anxiety disorder, depressive episode, ADHD, autism spectrum, or trauma — they do not diagnose any condition. Only a licensed clinician can diagnose.

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind. We make no guarantees that:

9. Crisis & safety resources

Nothing on Persona substitutes for professional crisis support. If you or someone you know is in immediate danger:

Features such as the AI coach chat, personality-reading generation, habit suggestions, and mood-entry analysis use large language models (currently provided by Anthropic). You acknowledge:

11. Limitation of liability

To the maximum extent permitted by law:

  1. Persona, its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, lost goodwill, or emotional distress — arising from your use of the Service, even if we were advised of the possibility of such damages.
  2. Our total aggregate liability for any claim relating to these Terms or the Service is limited to the amount you paid to Persona in the 12 months immediately preceding the claim, or $100, whichever is greater.
  3. Some jurisdictions do not allow certain limitations of liability. If you live in such a jurisdiction, the limitations above apply only to the extent permitted.

12. Indemnification

You agree to defend, indemnify, and hold harmless Persona and its affiliates from any claim, demand, loss, or expense — including reasonable legal fees — arising from: (a) your violation of these Terms, (b) your misuse of the Service, (c) content you submit, or (d) your violation of any third party's rights.

13. Termination

By you

You may stop using the Service and/or cancel your subscription at any time via the Manage Subscription page or by emailing billing@startpersona.com. You may request full account deletion by contacting privacy@startpersona.com.

By us

We may suspend or terminate your account without notice if we reasonably believe:

On termination, your subscription (if any) will end at the close of the current paid period, and sections of these Terms that by their nature survive termination (liability, IP, governing law, dispute resolution) continue to apply.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced via: (a) an updated "Last updated" date at the top of this page, and (b) where required by law, an email to your registered address. Continued use of the Service after changes take effect constitutes acceptance. If you don't agree with the updated Terms, you must stop using the Service and may request cancellation.

15. Governing law & disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute not resolved through arbitration (below) will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts. Nothing in this section restricts rights you may have under the mandatory consumer-protection laws of your country of residence.

16. Arbitration & class-action waiver

Any dispute arising out of or related to these Terms or the Service will be resolved by binding individual arbitration under the then-current rules of the American Arbitration Association's Consumer Arbitration Rules, administered by a single arbitrator. The arbitration will be conducted in English in Delaware or by video/phone if the amount in controversy is under $10,000.

Class-action waiver. You and Persona each waive the right to bring or participate in any class, collective, or representative action. Claims must be brought individually.

Opt-out. You may opt out of the arbitration clause within 30 days of creating your account by emailing legal@startpersona.com with "arbitration opt-out" in the subject line and your account email in the body.

17. Miscellaneous

Entire agreement

These Terms, together with the documents they incorporate by reference, constitute the entire agreement between you and Persona about the Service and supersede any prior agreements.

Severability

If any provision is found unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue in full force.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms (including in connection with a merger or sale) without notice.

No waiver

Our failure to enforce any provision does not waive our right to do so later.

Headings & interpretation

Headings are for convenience only. "Including" means "including without limitation." Examples are illustrative, not exhaustive.

Force majeure

We are not liable for failures or delays caused by circumstances beyond our reasonable control, including natural disasters, infrastructure outages, legal orders, war, pandemics, or denial-of-service attacks.
